Legal DNA Test is done for cases requiring your DNA Test report is to be used as an evidence in the Honorable courts of India. In such case, both sample collection and reporting are also different than a regular/peace of mind or other DNA tests.

For Legal DNA tests including Organ Transplant DNA Test and Immigration DNA Test, proper chain of custody is followed for the sample collection. Moreover, the test reports are sent to the respective authorities, like the embassy or the Organ Transplant Approval Committee or the transplant coordinator of the hospital or tranplant center.

For a court-approved Legal DNA Test in India, your samples will be collected either in the court room in front of the judge or in the presence of a court-appointed representative. The first requirement for such laboratories doing Legal DNA Tests for court cases, is that the testing lab should be from India and the second requirement is that the testing lab should be NABL-accredited.

As per the amendments in the Transplantation of Human Organs Act in 2014, now for Organ Transplantation it is necessary to confirm the relationship of living organ donor and recipient, for which Organ Transplant DNA test is a mandatory provision.

This test also happens in proper chain of custody in the following steps:

- Surgeon prescribes Organ Transplant to a patient
- An authorized sample collector from the testing laboratory collects the samples of the patient and donor in the presence of the surgeon. During sample collection, the involved parties and the surgeon sign on all the documents.
- After this, the testing lab analyzes the DNA samples.
- The test report is then submitted to the Transplant Coordinator, who in turn submits the report to the organ approval committee.
- Based on the findings of the test report, the comittee either allows or disallows the transplant.

Due to the addition of all these additional formalities and Form-5, the cost of Organ Transplantation DNA Test is also higher than a regular i.e. Peace of Mind relationship DNA test.

*Example-3* : *Immigration DNA Testing in India*

If you want to settle with a relative abroad, then proof of your relationship with your sponsor should be attached to the documents attached to your application. If your documents do not confirm your relationship with the sponsor, your visa application may be refused.

In such cases, it becomes mandatory for the immigration applicant and sponsor to get their DNA test done. We recommend that you get a DNA test done before applying and attach the test report with the primary documents. This increases the chances of visa approval.

It is important to understand here that different countries have different norms and specific requirements including different types of accreditations, like:

- ISO 17025 & ISO 15189 or NABL-accreditation, for immigration to India's neighboring countries
